Who applies

Any person who has legally acquired agricultural land through purchase (registered sale deed), inheritance (upon death of the previous owner), partition, gift deed, court decree, or government allotment and needs to update the revenue land records (RTC / Pahani / 7/12 extract / Jamabandi / Khata) to reflect their name as the current landowner

Who should use this process

  • Applicant must have a legally executed and registered document establishing transfer of ownership: registered sale deed (for purchase), registered gift deed, registered partition deed, succession certificate or legal heir certificate (for inheritance), or probate of will from a court of competent jurisdiction
  • For inheritance-based mutation, all legal heirs must either consent to the mutation or a succession certificate / legal heir certificate issued by the competent authority must be produced
  • The original owner must be reflected in the current RTC / 7/12 / Pahani as the owner-cultivator for the mutation to proceed; if the seller's name is not in the records, the previous mutation must be corrected first
  • The survey number and land details in the sale deed or transfer document must match the existing revenue records exactly; any mismatch (different survey number, area discrepancy) must be resolved with the tehsildar / revenue inspector before the mutation application is filed

Who does NOT need to apply

  • Unregistered sale agreements (agreement to sell without registered sale deed) do not confer ownership and cannot be the basis for mutation
  • Power of Attorney (PoA) transactions are not recognised as valid land transfer instruments under the Supreme Court's 2011 ruling (Suraj Lamp and Industries vs. State of Haryana); land transferred via PoA cannot be mutated without a registered sale deed
  • Agricultural land that cannot be transferred to the applicant category under state tenancy laws — for example, some states restrict sale of agricultural land to non-farmers (urban buyers); check state-specific land ceiling and tenancy laws
  • Land under litigation or with a court attachment order — mutation is stayed until the dispute is resolved by the court

    Obtain certified copies of the sale deed from the Sub-Registrar's Office

    Offline

    Within 30 days of registration of the sale deed, obtain a certified copy of the registered document from the Sub-Registrar's Office (SRO). This is the most important document for mutation. Also download the current RTC / 7/12 / Pahani from the state land records portal to have the current owner's details on record.

    Apply for mutation online through the state land records portal

    Most states now have online mutation portals: Karnataka (Bhoomi — bhoomi.karnataka.gov.in), Gujarat (AnyROR — anyror.gujarat.gov.in), Uttar Pradesh (Bhulekh — upbhulekh.gov.in), Maharashtra (MahaBhulekh — mahabhulekh.maharashtra.gov.in). Log in or register as a citizen, navigate to the mutation / khasra mutation section, enter land details (survey number, village, taluka, district), upload scanned copies of documents, and submit the application. Pay the mutation fee online. Note the application number / mutation case number for tracking.

    Revenue Inspector visits and field verification

    After the online application, the Circle Revenue Inspector (CRI) or Patwari / Village Revenue Officer (VRO) is assigned the case. They visit the land to physically verify that the land details (survey number, boundaries, area) match the documents, that the seller / transferor was in actual possession, and that there are no visible disputes. The CRI may also issue a public notice at the village notice board for 15–30 days inviting objections from neighbouring landowners or other potential claimants.

    Hear objections (if any) and submit report

    If any objection is received during the notice period, the tehsildar or revenue officer holds a summary inquiry and hears both parties before passing an order. If no objections are received and the documents are in order, the Revenue Inspector submits a recommendation report to the Tahsildar / Revenue Officer for final approval of the mutation.

    Mutation order passed by Tahsildar

    The Tahsildar (or competent revenue officer as per state law) reviews the Revenue Inspector's report and passes the mutation order updating the land records in the applicant's name. The mutation order is uploaded to the state land records portal. The applicant receives an SMS notification (in most states). Download the updated RTC / 7/12 / Pahani from the portal after the mutation order is posted — this is the official proof of land ownership update in revenue records.

    Collect updated land records and verify accuracy

    Download the updated RTC / 7/12 / Pahani / Jamabandi from the state land records portal. Verify that: your name is correctly spelled (matching Aadhaar), the survey number and area are correct, the previous owner's name has been removed, and the land classification (agricultural / non-agricultural) is correctly maintained. If there are errors, apply for correction (Sudhar) at the tehsildar office immediately — errors in land records are very difficult to correct later.

Things to watch out for

Mutation does not confer ownership — it only updates revenue records

A mutation entry in land records (RTC / 7/12 / Pahani) is a revenue record that determines who pays land revenue / agricultural tax. It is not a title deed. Legal title to land is conferred by a registered sale deed and can only be conclusively established in a civil court. If the sale deed has legal defects, the mutation does not cure those defects. Always obtain an Encumbrance Certificate for at least 13 years before purchasing agricultural land.

Delay in applying for mutation after purchase weakens your legal position

Although there is no strict legal deadline to apply for mutation after purchase, delays give rise to complications: the original seller's heirs may contest the transfer after the seller's death, the land may be re-sold to a third party by a fraudulent seller, or the land may be attached for the seller's debts. Apply for mutation within 3 months of registration of the sale deed and also inform the local revenue circle office informally to prevent fraud.

Inheritance mutation requires consent of ALL legal heirs

Revenue officers will not mutate inherited land in one heir's name alone without the written consent (NOC) of all other legal heirs or a court succession certificate naming all heirs. If even one heir disputes the mutation or is unreachable, the case goes into a prolonged inquiry. Secure all heirs' written consent before filing the mutation application to avoid delays.

Name mismatch between sale deed and Aadhaar causes processing delays

If the buyer's name in the sale deed does not exactly match the name in the Aadhaar card (e.g., initials vs. full name, spelling variations), the revenue officer may require an affidavit of identity or a gazette notification before accepting the mutation. Ensure the sale deed is executed with the buyer's name exactly as it appears in Aadhaar to avoid this complication.

Agricultural land purchase by non-farmers may be restricted under state tenancy laws

Several states (Karnataka, Uttar Pradesh, Kerala, Gujarat, Maharashtra) have restrictions on the purchase of agricultural land by non-agriculturalists or urban buyers under their tenancy and land reforms acts. If you are a non-farmer purchasing agricultural land, verify that the purchase is legally permissible and obtain the necessary exemption or permission from the District Collector or Agricultural Lands Tribunal before applying for mutation — otherwise the mutation will be rejected or cancelled.
